Terms of service
Effective
These terms apply to everyone who uses YRCAppointments: hosts, who have an account and a booking page, and guests, who book a time with a host. Please read them; they include limits on what we are responsible for.
1. Who we are and your agreement with us
YRCAppointments is an appointment scheduling service run by YRC — Your Resource Consultants (“we”, “us”). These terms are the agreement between you and us for using it.
You accept these terms when you create an account, and when you request an appointment through a host’s booking page. If you do not agree to them, do not use the service. If you use the service for a company or another organisation, you accept these terms on its behalf and confirm that you are allowed to.
Our Privacy policy explains how we handle personal information.
2. Accounts and eligibility
- You must be at least 16 years old, and old enough to enter into a binding agreement where you live, to create an account or to book an appointment.
- Give your real name and an email address you can read. A host’s booking page goes live only after they confirm their email address with the link we send.
- Keep your password to yourself. You are responsible for what happens under your account; tell us straight away if you think someone else has used it.
- The address you choose for your booking page must not impersonate someone else or infringe their rights. Some addresses are reserved, and we may reclaim one that breaks these terms. When an account is deleted, its address becomes available to others.
3. What the service does
A host sets their availability and event types and shares a public booking page. A guest picks a day and time on that page and sends a request. A request made on a booking page is not an appointment until the host confirms it: the host confirms or declines every request. The service sends both sides emails about the booking and lets them cancel it, and lets the guest ask to move it, while it is still ahead.
We are not a party to the appointment. An appointment is an arrangement between the host and the guest. We provide the tool that schedules it. We do not provide, supervise or guarantee the host’s services, we do not check who hosts or guests are, and we are not responsible for whether either of them turns up, for what happens at the appointment, or for anything the two of them agree between themselves.
Times are shown with their time zone. Check the time and zone in your confirmation email before relying on them.
4. Acceptable use
When you use the service, you must not:
- send spam, or make booking requests you do not intend to keep;
- publish or send anything unlawful, fraudulent, defamatory, harassing, hateful or infringing, or use the service to arrange anything unlawful;
- pretend to be another person or organisation, or give false contact details;
- scrape the service or collect other people’s information from it, or reach it by automated means other than a host’s own calendar feed and embedded booking page;
- try to get into accounts, bookings or data that are not yours, get around rate limits or other safeguards, or test the service for weaknesses without our written permission;
- disrupt the service or place an unreasonable load on it;
- upload malicious code, or content you have no right to use.
We may remove content, and suspend or close accounts, that break these rules.
5. Hosts’ responsibilities
If you are a host:
- Your page is yours. You are responsible for everything on your public booking page (your name, welcome message, logo, event types, locations and questions), for making sure it is accurate and lawful, and for having the right to use it.
- Your guests’ information is your responsibility. You decide what to ask guests, and you receive their names, email addresses, notes and answers. You must collect and use that information lawfully, only for the appointments it was given for unless the guest agrees otherwise, and you must tell your guests what you do with it where the law requires. We process it on your behalf, as our Privacy policy describes. Do not ask guests for sensitive information that you do not need.
- Copies you take are in your care. Your private calendar feed address works like a password: anyone who has it can read your bookings, so keep it private and replace it in your settings if it leaks. You are responsible for files you export and calendars you sync.
- Bookings you add by hand must be for people who asked you for that appointment.
- Answer requests in good time, and honour the appointments you confirm or cancel them properly.
6. Guests’ terms
If you book through a host’s page:
- Give your own name and email address, or those of the person you are booking for with their permission.
- Your request, with your details and answers, is passed to the host. It is confirmed only when the host confirms it, and the host may decline or cancel it.
- The emails we send you contain a private link to your booking. Anyone who has the link can see the booking and cancel or move it, so do not forward it to people you do not trust with that.
- Anything further (what the appointment involves, the host’s own conditions and cancellation rules) is between you and the host.
- If you cannot attend, cancel or move the booking with your link so the host knows.
7. Price
The service is currently provided free of charge. We may introduce paid plans in the future. If we do, we will tell hosts in advance, and no account will be moved to a paid plan unless its host chooses one.
8. Intellectual property
The service, including its software, design, text and the YRCAppointments name, belongs to YRC — Your Resource Consultants or its licensors. We give you a personal, non-exclusive, non-transferable right to use it in line with these terms, and nothing more.
What you put into the service stays yours. You give us permission to store, display and transmit it as far as needed to run the service for you: for example, to show your booking page to visitors and to send booking emails. That permission ends when the content is deleted.
If you send us suggestions about the service, we may use them without owing you anything.
9. Availability and changes to the service
We work to keep the service running, but we do not guarantee that it will always be available, free of errors, or that every email will arrive. There is no uptime commitment. The service may be interrupted for maintenance or for reasons outside our control.
We may add, change or remove features, and we may stop offering the service. If we plan to close it or to remove something hosts rely on, we will give reasonable notice where we can, so that hosts can export their bookings first.
Keep your own record of appointments that matter to you, for example in your own calendar.
10. Ending this agreement
You can stop using the service at any time. A host can delete their account in their settings. Deletion is immediate and permanent: it removes the account and all of its bookings, and guests with an appointment or request still ahead are told by email that it is cancelled.
We may suspend or close an account, or refuse a booking, if these terms are broken, if we need to in order to protect other people or the service, or if the law requires it. Where it is reasonable we will warn you first and give you a chance to put things right. We may also end the service for everyone, as described above.
The parts of these terms that are meant to outlast the agreement, such as the sections on intellectual property, disclaimers, liability and governing law, continue to apply after it ends.
11. Disclaimers
The service is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not vouch for hosts or guests, or for what they publish or tell each other, and we are not responsible for their conduct.
12. Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect or consequential loss, or for lost profits, revenue, business, goodwill or data, including loss caused by a missed, double or mistaken booking, or by an email that did not arrive;
- our total liability to you for everything connected with the service is limited to the fees you paid us for it in the twelve months before the claim arose. While the service is free of charge, that amount is zero.
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you keep the rights that the law of your country gives you and that an agreement cannot take away.
If someone brings a claim against us because of content you published or the way you used the service in breach of these terms, you agree to cover the reasonable costs and losses that result for us.
13. Governing law and disputes
These terms are governed by the laws of the State of Maryland, USA, and the courts of the State of Maryland, USA have jurisdiction over any dispute about them or about the service. If you are a consumer, this does not take away the protection of the mandatory laws of the country you live in, or your right to bring a claim in its courts.
Please contact us first if something has gone wrong; most problems can be settled without a formal dispute.
14. General
- These terms and the Privacy policy are the whole agreement between you and us about the service.
- If a court finds part of these terms unenforceable, the rest stays in force.
- If we do not enforce a term straight away, we can still enforce it later.
- You may not transfer your account or this agreement to someone else without our consent. We may transfer the agreement to a company that takes over the service.
15. Changes to these terms
We may update these terms as the service or the law changes. We will change the effective date at the top of this page, and if a change is significant we will tell hosts by email or in the dashboard before it takes effect. If you keep using the service after a change takes effect, you accept the new terms; if you do not agree, stop using the service and, if you are a host, delete your account.
